William M. McCarty

William M. McCarty was born in Trenton, New Jersey on January 17, 1938. After attending local schools, he enlisted in the United States Marine Corps, in which he served in various commands and was in the Silent Drill Team and Honor Guard at Marine Barracks 8th & I in Washington, D.C. until 1960. Upon discharge from the U.S.M.C., William McCarty enrolled at American University and later transferred to Dickinson College in Carlisle, Pennsylvania. In 1964, he received his B.A. in Economics. He then went on to Dickinson School of Law. While there, he was nominated to Dickinson Law Review, served as a National Vice President and served on the Board of Governors of the American Law Student Association (1966-1967). He obtained his Juris Doctor in 1967.

After obtaining his law degree, Mr. McCarty relocated with his family to Southern Vermont in 1967, and he went to work for Fitts and Olson. In 1971, he formed McCarty and Rifkin with James Rifkin. After Attorney Rifkin retired in 1978, the firm became McCarty Law Offices, P.C. As of January 1, 2006, associate attorney Bettina V. Buehler has become a Director and the firm is now known as McCarty & Buehler, P.C.

Attorney McCarty practices law in a wide range of areas, including Ski and Recreational Litigation, Negligence Law; Tort Law; Family Law; Divorce Law; Business Law; Personal Injury Law; Corporate Law; Municipal Law; Wills and Estate Planning. He handles trials in all civil courts. Among his reported cases are:

  • Smith v. Stewart, 163 VT (1996);
  • Naim v. Mt. Snow, 2dCCA, Trial Counsel, Fed. Rept. (1994);
  • Milligan v. Milligan 158 VT 436 (1992);
  • Fine Foods Inc. v. Dahlin 147 VT 599 (1987);
  • King v. Snide 144 VT 395 (1985), etc.

Throughout his years in Vermont, Attorney McCarty has been active in many civic and professional organizations. He is a member of the Windham County, Vermont and American Bar Associations, having served as President of the Windham County Bar Association (1992-1993) and as the State Chairman of the Standing Committee on Membership of the American Bar Association (1970-1976). He is also admitted to the United States District Court for the District of Vermont (1967), United States Court of Appeals, Second Circuit (1973); Federal District Court and the United States Supreme Court (1978).

From 1989 to 1997, Bill McCarty was the Chairman and a Member of the Windham County Bench-Bar Liaison Committee. Other professional memberships include: being honored and nominated for membership as an Advocate in the American Board of Trial Advocates; National Council of School Attorneys; American Judicature Society; Vermont Trial Lawyers Association; The Association of Trial Lawyers of America; Vermont Criminal Defense Attorneys Association; Advocate, American Board of Trial Advocates; Master, Vermont Inns of Court; and as Membership Chairman of the U.S. Supreme Court Historical Society (Vermont) from 1999-2003. He also served with Vermont Legal Aid as a Trustee from 1970-1982, Treasurer of the Board of Trustees from 1972 to1979, and as President in 1979-1980. Bill McCarty was honored to win the VTLA Outstanding Litigation Achievement Award in 1994.

Bill McCarty's many civic involvements include serving as the Brattleboro Representative to the Windham Regional Planning and Development Commission from 1968 to 1970 and as Clerk for the Brattleboro Zoning Board of Adjustments, 1968-1973. He has been involved with the Brattleboro Winter Carnival as a Member of the Board of Governors (1968-1973) and as President (1971-1972). He is a long-standing member of the Brattleboro Area Chamber of Commerce, and served on the Board of Managers, 1971-1972.

Attorney McCarty has been involved with continuing legal education as a speaker and lecturer with many organizations, including: the Vermont Bar Association; the Vermont Trial Lawyers Association and the National Education Network. His lectures have focused on the subjects of Litigation and Advocacy; Ski Area Liability; Automobile Liability; Personal Injury Law; Family Law; Discovery; The Art of Cross Examination; Depositions and Discovery; and Litigation and Trial Techniques.

Bill McCarty has been listed in many publications of notable citizens and attorneys, among them Who's Who in American Law (1983-1984, and 1998-1999); Who's Who in America (2001); Who's Who in Finance & Industry (2000-2001); and Who's Who in the World (1991). He has been voted Best attorney in Brattleboro for 5 consecutive years, since 2000.

He continues to be a proud member of the Marine Corps League and attends annual reunions of the 8th & I, Silent Drill Team in Washington, D.C.
